It has been several months since Paul Walker and his friend Roger Rodas were killed in a fiery car crash.

Roger, the driver, was supposedly driving 94 miles-per-hour when the car crashed and burst into flames killing both himself and Paul. However, Roger’s wife Kristine M. Rodas is arguing the fact, and claims that Roger was only driving 55 miles-per-hour, which is a safe speed.

On Monday, Kristine filed a wrongful death lawsuit against Porsche stating that the 2005 Porsche Carrera GT the men were driving, capable of running 200 miles-per-hour, “lacked a proper crash cage and safety features in the gas tank,” which ultimately caused the death of her husband.

“The Carrera GT was unsafe for its intended use by reason of defects in its manufacture, design, testing, component and constituents, so that it would not safely serve its purpose,” the lawsuit reads.

Kristine’s attorney Mark Geragos said that he hired experts in the field to study the crash and they found that Roger was not traveling at the speed the police suggested. The Los Angeles County Sheriff’s Department and California Highway Patrol originally cited unsafe speed, not mechanical problems, as the cause of the men’s death. Porsche aided in their initial investigation.

Roger, an experienced race car driver, left behind two small children upon his death. Paul, the star of the Fast and Furious film franchise, left behind a teenage daughter, and co-owned, with Roger, a racing team called Always Evolving.

The lawsuit seeks unspecified damages. Porsche has not commented on the lawsuit.
