Kathleen McCormack disappeared in 1982, a young woman with dreams of becoming a pediatrician. Had her home life not been so troubled, her family might still be wondering what happened to her, but they say they believe she’s long dead, and they know who’s responsible.
McCormack, who was married to Robert Durst–subject of the HBO documentary The Jinx and suspected murderer–allegedly took herself to the hospital in the Bronx just a few weeks before she disappeared with facial lacerations, saying Durst had beaten her during an argument. Her family alleges that Durst was emotionally and physically abusive to her throughout their marriage, and had Kathleen declared dead in 1988 despite never finding her body. Durst maintains that he put his wife on a train to New York City on the night she disappeared, and no charges have been filed against him.
Charges were filed, however, after he was found with a weapon in his possession despite being a convicted felon, and he will face murder charges in the death of his friend and former associate Susan Berman in the coming months. Now, McCormack’s family has filed a $100 million lawsuit against the real estate heir for the wrongful death of Kathleen; the lawsuit claims that Durst has prevented them from being able to give her a proper burial.
“The family’s priority has been, and continues to be, to provide Kathleen with a proper and dignified burial,” said McCormack family attorney Robert Abrams.
Durst maintains his innocence in Kathleen’s disappearance despite mumbling “I killed them all” while being recorded for The Jinx. His attorney says that there is simply no proof.
“We’re not going to comment on it until the day it happens. There is no evidence that Robert Durst had anything to do with Kathleen’s disappearance. Anybody can file a lawsuit, but eventually they’ll have to come with evidence,” said attorney Dick DeGuerin.
