Josh Duggar, disgraced eldest son of the former 19 Kids and Counting family, has filed to dismiss a battery lawsuit porn star Danica Dillon filed against him.
In documents that were filed on December 30, and obtained by Entertainment Tonight, attorney Jeffrey A. Conrad argues that Danica Dillon “did not provide anything more than a formulaic recitation of the elements of assault and/or battery,” adding, “Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment.”

A source from within the Duggar family tells ET, “In court, it doesn’t matter who is right or wrong. It’s who can prove it. And that’s just the plain and simple way the world works.”
“Sometimes it’s unfair, it’s just the way it is. If you can’t prove it, regardless of if it happened or not, that’s what the court goes by, is evidence,” the source continues. “Josh is a smart guy, and I hope to god he is getting the help he needs.”
Danica Dillon filed the battery lawsuit against Josh Duggar in November, alleging he caused her “physical and emotional injuries.” She is asking for $500,000 in damages in the lawsuit.
In September, the porn star was candid with Entertainment Tonight about the sexual interactions between her and Josh Duggar.
“He threw me on the bed and, in all honesty, though it was consensual it more or less felt like I was being raped,” Danica Dillon said at the time, adding that Josh Duggar also allegedly offered her $1,500 to have sex with him in both March and April of 2014.
“I never said no, I am going to have to reiterate that, I never told him no,” she told ET. “But I did push him back and push him off and say that’s too rough, that’s too rough.”

It was in August that Josh Duggar, on the heels of a sex scandal involving the sexual molestation of five underage girls–four of whom are his sisters–that Josh Duggar admitted to yet another sex scandal. He was outed during the Ashley Madison website hack, and admitted to cheating on wife, Anna Duggar, and to an addiction to pornography. Shortly thereafter, the 19 Kids and Counting family shuttled him off to a faith-based rehab in Illinois, where he has supposedly been receiving treatment for his “sexual sins.”
It really does sound like Danica Dillon might be taking advantage of the notoriety now attached to the former 19 Kids and Counting star’s name. It will be very interesting, however, to learn if Josh Duggar is able to get this lawsuit against him dismissed.
